{"id":379,"date":"2016-05-24T16:59:26","date_gmt":"2016-05-24T20:59:26","guid":{"rendered":"http:\/\/www.floridainjuryattorneysblawg.com\/?p=379"},"modified":"2017-04-11T17:22:30","modified_gmt":"2017-04-11T21:22:30","slug":"injured-workers-right-hire-workers-compensation-attorney-restored-first-dca","status":"publish","type":"post","link":"https:\/\/www.joannhoffman.com\/blog\/injured-workers-right-hire-workers-compensation-attorney-restored-first-dca\/","title":{"rendered":"Injured Workers Right to Hire a Workers Compensation Attorney Restored by the First DCA"},"content":{"rendered":"<p style=\"text-align: justify\">In <a href=\"https:\/\/edca.1dca.org\/DCADocs\/2015\/0165\/150165_1287_04202016_022330_i.pdf\"><u>Miles vs. City of Edgewater Police<\/u><\/a>, 1D15-0165 the First District Court of Appeal declared Florida Statutes 440.105(3)(c) and 440.34 unconstitutional because they infringe on the Claimant\u2019s right to contract to pay attorney\u2019s fees from their own funds for litigating a workers compensation claim.\u00a0 Any contract for fees for representing an injured person must like all fees for Florida attorneys comply with the factors set forth in <a href=\"http:\/\/law.justia.com\/cases\/florida\/supreme-court\/1968\/36523-0.html\"><u>Lee Engineering<\/u><\/a>, 209 So.2d. 454, 458 (Fla. 1968) and the Florida Bar Rule 4-1.5(b).\u00a0 In <u>Miles<\/u>, the 1<sup>st<\/sup> DCA stated \u201cwe hold that no attorney accepting fees, per such a fee contract in this situation may be prosecuted under 440.105(3)(c) Fla.
