Many times an injured person is entitled to both <a href=\"https:\/\/www.joannhoffman.com\/lawyer-attorney-1717058.html\" target=\"_blank\">workers\u2019 compensation<\/a> benefits as well as a third party settlement.\u00a0 Since the workers\u2019 compensation doctors are often conservative and will not recommend procedures, including surgery, those procedures and surgeries may be paid for under a letter of protection or out of the third party settlement.<\/p>\n<p style=\"text-align: justify\">Where the workers\u2019 compensation carrier has provided benefits, they will have a lien for the amount they have paid.\u00a0 The amount the injured person has to pay back to the workers\u2019 compensation carrier is determined by the formula set forth in the case of <a href=\"https:\/\/scholar.google.com\/scholar_case?case=11759727170035684001&amp;q=Manfredo+v.+Employer%E2%80%99s+Casualty+Ins.+Co.,+560+So.2d+1162+(Fla.+1990).&amp;hl=en&amp;as_sdt=40006\" target=\"_blank\"><i>Manfredo v. Employer\u2019s Casualty Ins.
