Are there any circumstances in which an injured worker can pick his or her own physician?\u00a0 The answer to this question is \u201cYes.\u201d<\/p>\n<p style=\"text-align: justify\">Under <a href=\"http:\/\/www.flsenate.gov\/laws\/statutes\/2011\/440.13\" target=\"_blank\">Section 440.13(2)(f), Florida Statutes (2011)<\/a>, the Claimant is allowed a one-time change of physician for the life of the case.\u00a0 The request for the one-time change made by an injured worker must be approved and the Claimant must be notified within five (5) days.<\/p>\n<p style=\"text-align: justify\">In the case of\u00a0 <a href=\"https:\/\/scholar.google.com\/scholar_case?case=16185159251016639064&amp;q=Bustamante+v.+Amber+Construction+Co.+and+American+Interstate+Ins.+Co.+(Fla.+1st+DCA+2013)&amp;hl=en&amp;as_sdt=40006\" target=\"_blank\">Bustamante v. Amber Construction Co. and American Interstate Ins. Co.<\/a> (Fla. 1<sup>st<\/sup> DCA 2013), the injured worker\u2019s attorney emailed the request for a one-time change to the adjuster on September 25, 2012.\u00a0 The adjuster responded the following day, stating that he would contact another provider to see if one of their orthopedics would take over treatment.\u00a0 Thereafter, the adjuster faxed a letter to the new orthopedic advising them that they were authorized to \u201cevaluate and treat claimant.\u201d<\/p>\n<div class=\"read_more_link\"><a href=\"https:\/\/www.joannhoffman.com\/blog\/one-time-change-required-five-days-floridas-workers-compensation-law\/\"  title=\"Continue Reading One-Time Change Required Within Five Days Under Florida\u2019s Worker\u2019s Compensation Law\" class=\"more-link\">Continue reading \u2192<\/a><\/div>\n","protected":false},"excerpt":{"rendered":"<p>In worker&#8217;s compensation cases, the Employer\/ Carrier has the right to select the injured worker\u2019s physician.
