Let&#8217;s look at how the courts have typically analyzed this issue.<\/p>\n<p>Psychological claims that occur as a result of cumulative exposure to harsh and dangerous working conditions such as the hazards of working in a war zone are designated as an occupational disease.\u00a0 Specifically, courts have defined an \u201coccupational disease\u201d as a disease caused by hazardous conditions of employment, which are peculiar to the employee\u2019s employment as opposed to other employment generally.\u00a0 Hazardous activity need not be exclusive to the particular employment, but it must be sufficiently distinct from hazardous conditions associated with other types of employment.\u00a0 <a href=\"https:\/\/cite.case.law\/f2d\/892\/173\/\"><em>Gencarelle v. Gen. Dynamics Corp.<\/em>, 892 F.2d 173, 23 BRBS 1 (CRT) (2d Cir. 1989), <em>aff\u2019d<\/em>\u00a022 BRBS 170 (1989)<\/a>.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-787 alignleft\" src=\"https:\/\/www.joannhoffman.com\/blog\/wp-content\/uploads\/2020\/11\/employers-300x225.jpg\" alt=\"employers-300x225\" width=\"300\" height=\"225\" srcset=\"https:\/\/www.joannhoffman.com\/blog\/wp-content\/uploads\/2020\/11\/employers-300x225.jpg 300w, https:\/\/www.joannhoffman.com\/blog\/wp-content\/uploads\/2020\/11\/employers-160x120.jpg 160w, https:\/\/www.joannhoffman.com\/blog\/wp-content\/uploads\/2020\/11\/employers.jpg 640w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/>The last employer rule specifically applies in occupational disease cases.\u00a0 <a href=\"https:\/\/cite.case.law\/f2d\/140\/10\/\"><em>Travelers Ins. Co. v. Cardillo<\/em>, 225 F.2d 137, 145 (2d Cir. 1955), <em>cert. denied<\/em>, 350 U.S. 913 (1955)<\/a>.\u00a0 The title \u201clast employer rule\u201d is sometimes given to each of the different tests for determining liability among several employers in a LHWCA matter.\u00a0 <a href=\"https:\/\/www.leagle.com\/decision\/19911571950f2d62111463#\"><em>See Foundation Constructors, Inc.<\/em>, 950 F.2d 621, 624 (9th Cir. 1991)<\/a>. \u00a0\u201cWhether it is characterized as two different rules, or different applications of the same rule,\u201d courts use two tests, one for traumatic injury and one for occupational disease, when evaluating employer liability under the Act.\u00a0 <em>Id<\/em>.\u00a0 The Rule limits liability to \u201cthe employer during the last employment in which the claimant was exposed to injurious stimuli, prior to the date upon which the Claimant became aware of the fact he was suffering from an occupational disease arising out of his employment.\u201d\u00a0 <em>Travelers Ins. Co. v. Cardillo<\/em>, 225 F.2d 137, 145 (2d Cir. 1955), <em>cert. denied<\/em>, 350 U.S. 913 (1955); <em>see also<\/em> <a href=\"https:\/\/casetext.com\/case\/fulks-v-avondale-shipyards-inc\"><em>Fulks v. Avondale Shipyards, Inc.<\/em>, 637 F.2d 1008, 1012 (5th Cir 1981)<\/a>; <a href=\"https:\/\/caselaw.findlaw.com\/us-4th-circuit\/1453504.html\"><em>Newport New<\/em><em>s Shipbuilding &amp; Dry Dock Co. v.
