Martin Elecs., Inc., 932 So.2d, 1104 (Fla.2006)<\/a>.<\/p>\n<p>If you are injured on the job or in the scope of your employment you may have a worker\u2019s compensation claim against your employer\/insurance company and you may also have a claim any negligent third-parties.<\/p>\n<p>The injured employee has one year from the date of accident\/injury to file a lawsuit against the negligent third-party. The employer, the party paying the worker\u2019 compensation benefits has two years to bring suit. \u201cAt the end of the second year, the rights of action revert to the employee, but are (as before) subject to the employer or insurer&#8217;s subrogation and lien rights.\u201d <a href=\"https:\/\/casetext.com\/case\/luscomb-v-liberty-mut?q=Luscomb%20v.%20Liberty%20Mut.%20Ins.%20Co.,%20967%20So.%202d%20379,%20381%20(Fla.%20Dist.%20Ct.%20App.%202007)&amp;PHONE_NUMBER_GROUP=P&amp;sort=relevance&amp;p=1&amp;type=case\">Luscomb v. Liberty Mut. Ins. Co., 967 So. 2d 379, 381 (Fla. Dist. Ct. App. 2007)<\/a>.<\/p>\n<p>Although, you may have a workers\u2019 compensation claim against your employer and a claim against any negligent third-party you will not be able to double dip. <a href=\"http:\/\/www.leg.state.fl.us\/Statutes\/index.cfm?App_mode=Display_Statute&amp;Search_String=&amp;URL=0400-0499\/0440\/Sections\/0440.39.html\">Florida Statute 440.39 (2020)<\/a>; <a href=\"https:\/\/casetext.com\/case\/jones-v-martin-electronics-inc-1\">Jones v. Martin Elecs., Inc., 932 So.2d 1100, 1108 (Fla.2006)<\/a>.<\/p>\n<p style=\"text-align: left;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-76 alignleft\" src=\"https:\/\/www.joannhoffman.com\/blog\/wp-content\/uploads\/2013\/11\/posterwithcaption-1-300x248.jpg\" alt=\"posterwithcaption-1-300x248\" width=\"300\" height=\"248\" srcset=\"https:\/\/www.joannhoffman.com\/blog\/wp-content\/uploads\/2013\/11\/posterwithcaption-1-300x248.jpg 300w, https:\/\/www.joannhoffman.com\/blog\/wp-content\/uploads\/2013\/11\/posterwithcaption-1-145x120.jpg 145w, https:\/\/www.joannhoffman.com\/blog\/wp-content\/uploads\/2013\/11\/posterwithcaption-1.jpg 374w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/> <a href=\"http:\/\/www.leg.state.fl.us\/Statutes\/index.cfm?App_mode=Display_Statute&amp;Search_String=&amp;URL=0400-0499\/0440\/Sections\/0440.39.html\">Florida Statute 440.39 (2020)<\/a> mandates that an employer who has provided benefits to an injured employee is entitled to place a lien on a settlement from a third-party for the amount that the employer has paid in benefits. \u00a0The employer can also elect to waive the lien. An employer providing workers\u2019 compensation benefits to an injured employee can place a lien on any monies paid out for medical, wage loss benefits as well as future medical benefits that are part of an employee\u2019s settlement with a negligent third-party. <a href=\"https:\/\/casetext.com\/case\/city-of-lakeland-v-stapleton?q=City%20Of%20Lakeland%20v.%20Stapleton,%20875%20So.%202d%20784%20(Fla.%20Dist.%20Ct.%20App.%202004)&amp;PHONE_NUMBER_GROUP=P&amp;sort=relevance&amp;p=1&amp;type=case&amp;resultsNav=false\">City of Lakeland v.
